We thought it would be a good idea to at least have something on the site about our Terms of Use. The information below is not exhaustive but is our way of assisting you to understand what we expect of you as a lister on our website. They have been complied with consideration from what other similar sites are saying however these terms not an exhaustive list of our all out terms. These terms will change from time to time as situations arise that prompt us to extend, clarify or modify them for the greater good.
Users who violate these Terms may have their access and use of the Bob's Jobs Sites suspended or terminated, at our discretion. There will be no refunds in cases where the lister has clearly violated our terms of use. Typically we will warn and consult with any offender before taking such measures.
Introduction
Welcome to one of the Bob's Jobs group of websites, Bob's Flatmates. By accessing Bob's Flatmates you are agreeing to the following terms, which are designed to make sure that Bob's Jobs Network workd for everyone.
The materials in the Bobs Flatmates site are provided without warranty of any kind either expressed or implied. By using this website you must understand that all listings are made directly by a third party, usually an individual wanting to advertise their space (accommodation/clinical). We DO NOT carry out any verification of any type on the content displayed in the listings sections of this website. It is therefore important for any user to be diligent in any online correspondance. We have however created a Safety Tips page - http://www.bobsflatmates.com/safetytips.aspx which we hope is of use in protecting users against unwary listers. We also have a Report a Listing form on all listings which can be used by a viewer to report anything they feel was suspect in anyway. We rely on our users to monitor the safety and validity of listings on the site.
The Bob's Jobs Network sites are defined as any websites under our control, whether partial or otherwise (including, without limitation, Physiobob.com, Speech-Bob.com, OT-Bob.com, Social-Bob.com, Bobs Flatmates and the websites from which these terms of use were accessed from. The Bob's Jobs Network includes a variety of features and services, including an on-line service to post and search employment opportunities (“Bob's Jobs Services”).
Specifically the Bob's Flatmates website includes, but is not limited to, features that allow a user/viewer to list and also to view: rooms available for rent or wanted to rent, clinical space to rent or purchase and practices for sale and wanted to buy.
Other Bob's Jobs Networks sites also include on-line communities designed to facilitate valuable professional and personal networking among users of the Bob's Jobs Sites (“Users”) based on common experiences and interests (“Bob's Jobs Communities”). The Bob's Jobs Sites also allow Users to create individual profiles, which may include personal information (”Profiles”), and to make these Profiles, or aspects thereof, public.
Using Bob's Flatmates
As a condition of your use of Bob's Flatmates you agree that you will not:
• violate any laws;
• violate the listing rules (listed on at the top of the listing page);
• post any threatening, abusive, defamatory, obscene or indecent material;
• be false or misleading;
• infringe any third-party right;
• distribute or contain spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm Bob's Flatmates or the interests or property of its users;
• impose an unreasonable load on our infrastructure or interfere with the proper working of Bob's Flatmates;
• copy, modify, or distribute any other person's content without their consent;
• use any robot spider, scraper or other automated means to access Bob's Flatmates and collect content for any purpose without our express written permission;
• harvest or otherwise collect information about others, including email addresses, without their consent;
• bypass measures used to prevent or restrict access to Bob's Flatmates.
You are solely responsible for all information that you submit to Bob's Flatmates and any consequences that may result from your listing. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breeching the above terms. We also reserve the right at our discretion to restrict a user's usage of the site either temporarily or permanently, or refuse a user's registration.
Listings
A Listing may not contain:
(a) misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the opportunity being presented, as determined in Bob's Flatmates reasonable discretion;
(b) the names, logos or trademarks of unaffiliated companies other than those of your customer save where expressly agreed by Bob's Flatmates;
(c) the names of colleges, cities, states, towns or countries that are unrelated to the posting;
(d) more than one job or job description, more than one location, or more than one job category, unless the product so allows;
(e) inaccurate, false, or misleading information; and
(f) material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 16.
You may not use your Bob's Flatmates Listing to:
(a) post listings in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;
(b) post listings that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract;
(c) post listings that include any screening requirement or criterion in connection with a job or course posting where such requirement or criterion is not an actual and legal requirement of the posted job or course;
(d) post listings or other advertisements for competitors of Bob's Flatmates or post other content that contains links to any site competitive with Bob's Flatmates;
(e) sell, promote or advertise products or services;
(f) post any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative agency arrangement;
(g) post any business opportunity that requires an up front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;
(h) post any business opportunity that pays commission only unless the posting clearly states that the available job or course pays commission only and clearly describes the product or service that the job seeker would be selling;
(i) promote any opportunity that does not represent bona fide employment;
(j) post jobs or courses on any Bob's Jobs Network site for modeling, acting, talent or entertainment agencies or talent scouting positions;
(k) advertise sexual services or seek employees for jobs of a sexual nature;
(l) request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;
(m) endorse a particular political party, political agenda, political position or issue;
(n) promote a particular religion;
(o) post listings located in countries subject to economic sanctions of the United Kingdom Government; and
(p) except where allowed by applicable law, post jobs or courses which require the applicant to provide information relating to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
If at any time during Your use of the Bob's Flatmates services, You made a misrepresentation of fact to Bob's Flatmates or otherwise misled Bob's Flatmates in regards to the nature of Your business activities, Bob's Flatmates will have grounds to terminate Your use of the Bob's Flatmates service. Bob's Flatmates reserves the right to remove any listing/content from Bob's Flatmates, which in the reasonable exercise of Bob's Flatmates discretion, does not comply with the above Terms, or if any content is posted that Bob's Flatmates believes is not in the best interest of Bob's Flatmates.
Abusing Bob's Flatmates
Bob's Flatmates and our community of support staff and users work together to keep the site working properly and the community safe. Please report problems, offensive content and policy breaches to us using the contact us page.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Bob's Flatmates if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Bob's Flatmates or not, we do not accept any liability for monitoring Bob's Flatmates or for unauthorised or unlawful content on Bob's Flatmates or use of Bob's Flatmates by users.
Global Marketplace
Some of Bob's Flatmates features may display your ad on other sites or web-based services that are part of the the Bob's Jobs Network. This includes but it not limited to our forums, our iPhone applications and our toolbar services. By using Bob's Flatmates, you agree that your ads can be displayed on these other sites. The terms for our other sites are similar to these terms, but you may be subject to additional laws or other restrictions in the countries where your ad is posted. When you choose to post your ad on another site, you may be responsible for ensuring that it does not violate our other site policies. We may remove your ad if it is reported on any our sites, or if we believe it causes problems or violates any law or policy.
Fees and Services
We may from time to time charge a small fee for using/listing on Bob's Flatmates. See our Pricing Page for more information. If the service you use incurs a fee, you'll be able to review and accept terms that will be clearly disclosed at the time you post your ad. Our fees are quoted in Pounds Sterling, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service
Our fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.
Content Related Liabilities
Bob's Flatmates CANNOT be held responsible for any events that transpire through use of our service. It is each users responsibility to determine the character and acceptability of any prospective candidate or employer. Bob's Flatmates is not and will not be responsible for error or omissions that may occur, consequential or other wise.
Bob's Flatmates contains content from us, you, and other users. Bob's Flatmates is protected by copyright laws and international treaties. Content displayed on or via Bob's Flatmates is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from Bob's Flatmates without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Bob's Flatmates. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of Bob's Flatmates (other than your own content). When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.
The Bob's Jobs Network provides a venue for individuals to network for professional and personal purposes and Bob's Jobs does not screen or censor the Profiles or User Content on the Bob's Flatmates site. Bob's Flatmates is not involved in the actual communications between Users. As a result, Bob's Flatmates has no control over the accuracy, reliability, completeness, or timeliness of the Profiles or User Content submitted on the Bob's Flatmates site and makes no representations about any Profile or User Content on the Bob's Flatmates website.
Note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the Bob's Flatmates sites. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that You will use caution and common sense when using the Bob's Flatmates site.
Because User authentication on the Internet is difficult, Bob's Flatmates cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in User-to-User dealings or control the behavior of participants on any Bob's Flatmates site, in the event that You have a dispute with one or more Users, You release Bob's Flatmates (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.
Bob's Flatmates does not provide or make any representation as to the quality or nature of any of the third party products or services purchased through any Bob's Flatmates site, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of such third party products or services, under the terms agreed to by the provider.
If You believe that something on the Site violates these Terms please contact us via our Contact Us pages or the Report a Listing link which is shown on all listings.
If notified of any content or other materials which allegedly do not conform to these Terms, Bob's Flatmates may, at its sole discretion, investigate the allegation and determine whether to remove or request the removal of the content. Bob's Flatmates has no liability or responsibility to Users for performance or nonperformance of such activities.
You agree to defend, indemnify, and hold harmless Bob's Jobs, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to any Bob's Flatmates site, (ii) Your use of any Bob's Flatmates Content, or (iii) Your breach of these Terms. Bob's Flatmates shall provide notice to You promptly of any such claim, suit, or proceeding.
Personal Information
By using Bob's Flatmates, you agree to the collection, transfer, storage and use of your personal information by Bob's Flatmates on servers located in the United Kingdom. You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications. We will provide an unsubscribe link at the bottom of all email correspondence.

General
These terms and the other policies posted on Bob's Jobs constitute the entire agreement between Bob's Jobs and you, superseding any prior agreements.
This Agreement shall be governed and construed in all respects by the laws of England and Wales. You agree that any claim or dispute you may have against us must be resolved by the courts of England and Wales. You and Bob's Flatmates both agree to submit to the exclusive jurisdiction of the English Courts; for claims falling within the jurisdiction of a County Court, you and Bob's Jobs both agree to submit to the jurisdiction of the County Courts of the Greater London Region.
If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
Except for notices relating to illegal or infringing content, your notices to us must be sent by email using our site specific contact forms. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing.
We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the site, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us. |
